Each party shall bear its own costs and attorneys’ fees, and the parties shall equally share the fees and expenses of the arbitrator unless otherwise determined by the arbitrator.

15. Class Action Waiver

To the fullest extent permitted by applicable law, you and GEDIH GLOBAL LLC agree that any dispute resolution proceedings shall be conducted only on an individual basis and not in a class, consolidated, collective, or representative action. You and GEDIH GLOBAL LLC each waive the right to a trial by jury and the right to participate as a plaintiff or class member in any purported class action or representative proceeding. Unless both you and GEDIH GLOBAL LLC agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

16. Force Majeure

GEDIH GLOBAL LLC shall not be liable for any failure or delay in performance of its obligations under these Terms arising from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, riot, embargo, epidemic, pandemic, natural disaster, fire, flood, earthquake, power outage, network failure, telecommunications failure, governmental action, strike, or labor dispute. The obligations and rights of the party affected by a force majeure event shall be suspended for the duration of such event and the time for performance shall be extended by a period equivalent to the duration of the delay.
